Whistleblowing System of Tiroler Flughafenbetriebsgesellschaft m.b.H.

Whistleblowing System of Tiroler Flughafenbetriebsgesellschaft m.b.H. and Freedom of Information Act

The success of our company depends significantly on the trust of our stakeholders. To maintain and further strengthen this trust, it is essential that our employees comply with all legal provisions and internal regulations in their decisions and actions, and that they also behave in a morally responsible manner.

Tiroler Flughafenbetriebsgesellschaft m.b.H. therefore provides its employees and business partners with the opportunity to report violations relating to specific areas of the Federal Act on the Procedure and Protection for Reporting Legal Violations in Certain Legal Areas (Whistleblower Protection Act – HSchG), as well as breaches of the company’s internal Code of Conduct.
By doing so, they can contribute to the company’s economic success in a way that is consistent with social, legal, corporate and environmental responsibility.

For this purpose, Tiroler Flughafenbetriebsgesellschaft m.b.H. operates a whistleblower system that allows whistleblowers to submit reports confidentially. The system is internet-based, providing the opportunity to report actions that violate the rules mentioned above, either anonymously or with identification, 24 hours a day.

If you have received information about unlawful behavior, do not hesitate to contact us. By providing your report, you help prevent material and immaterial damage to the company and preserve its integrity.

Further information about the reporting process and which violations can be reported can be found in the FAQs.

The whistleblower system is available internally to all employees and externally to all business partners and other stakeholders.

Reports are only considered if they concern a violation covered by the scope of the Federal Act on the Procedure and Protection for Whistleblowers and Legal Violations in Certain Legal Areas (Whistleblower Protection Act – HSchG) or a violation of the company’s internal code of conduct that is likely to cause significant damage to the company.

The Federal Act of 24 February 2023 on the Procedure and Protection for Whistleblowers Regarding Legal Violations in Certain Legal Areas (Whistleblower Protection Act – HSchG) allows, in particular, reporting of violations in the areas of public procurement, financial services, product safety and compliance, traffic safety, environmental protection, radiation protection and nuclear safety, public health, consumer protection, as well as the protection of personal data and the security of network and information systems.

Behaviors that constitute criminal offenses against the company’s interests, such as fraud, corruption, or conflicts of interest, are therefore also reportable, as are actions that violate human rights or environmental protection.

In addition, Tiroler Flughafenbetriebsgesellschaft m.b.H. also allows the reporting of violations against the company’s internal code of conduct if such violations are likely to cause significant damage to the company.

Significant damage can result from the commission of a criminal offense but may also include harm to the company’s reputation.

Cases concerning aviation safety (“Safety”) may not be reported through this system. These should continue to be submitted via the established safety reporting channels.

Reports that serve only personal interests are also not eligible.

The introduction of the whistleblower system carries the risk that it could be misused to denounce other individuals without cause or verification, thereby damaging their reputation. Such reports serve solely personal interests and do not reveal internal company misconduct or unlawful behavior within the meaning of the EU Directive or the applicable code of conduct. Therefore, they must not be submitted through the whistleblower system.

Reports of suspected legal violations can be submitted via the digital whistleblowing system introduced by Tiroler Flughafenbetriebsgesellschaft m.b.H.

Digital Whistleblowing System

Tiroler Flughafenbetriebsgesellschaft m.b.H., in cooperation with the software provider Akarion, has implemented a digital whistleblowing system that enables both internal and external whistleblowers to submit reports either anonymously or by name.

An internal reporting office (Whistleblower Office) has been established within Tiroler Flughafenbetriebsgesellschaft m.b.H. The Whistleblower Office receives reports for review. All processing takes place within a secure, IT-based closed system to which only the Whistleblower Office has access. Access by unauthorized third parties is excluded.

The homepage of the whistleblowing tool contains two buttons.

By selecting “Submit Report”, a new reporting process is started, which consists of several steps.

First, the incident must be described. Documents and photos can be uploaded to verify or substantiate the report. Certain fields, such as the incident description and the date of the incident, are mandatory and marked with an asterisk (*). Additional details can be provided in optional fields that follow.

During the reporting process, you can decide whether to submit the report anonymously or by name. If you choose to submit your name, it will be known only to the Whistleblower Office and will not be shared with any other persons. Your personal data will be processed exclusively in accordance with our Privacy Policy.

After confirming that your report is submitted to the best of your knowledge and in good faith, you can send the report.

Once submitted, the report is registered in the system and a personal mailbox is automatically created for you as the whistleblower. You will receive a report ID and a password, which allow you to access your mailbox at any time and communicate with the Whistleblower Office. These login details are known only to you. Please keep them in a safe place until your report has been fully processed. Access by third parties is excluded.

Communication between the Whistleblower Office and you as the whistleblower takes place within a secure, closed online system — a personal mailbox. Using the login details provided after submitting your report, you can check the status of the procedure at any time, communicate with the Whistleblower Office, and supplement or correct your report whenever necessary.

Once a report is submitted through the whistleblowing system, it is received directly within the platform. As the whistleblower, you will immediately receive an automatic confirmation of receipt.

Within three months of this confirmation, you will receive a qualified update regarding the status of the procedure and any measures taken or planned.

Using the individual ID provided to you, you can log into the whistleblowing system at any time to check the current status of your report, communicate with the Whistleblower Office, and respond to any follow-up questions.

As a whistleblower, you are granted special protection based on the applicable legal framework.

This protection applies only if, at the time of submitting the report, you had reasonable grounds—based on the factual circumstances and the information available to you—to believe that the information you provided was true and fell within the scope of the whistleblowing legislation. Your identity, your report, and all communication with the Whistleblower Office remain strictly confidential and are protected through appropriate technical and organizational measures within the system.

Clearly false or misleading reports will be rejected by the Whistleblower Office. Such reports may give rise to claims for damages or may be subject to judicial or administrative proceedings.
